Wicked cease & desist and Henbrandt remove costumes

Following the announcement of Wicked Costumes Ltd having agreed to cease and desist selling certain costumes, the company have agreed to cease and desist selling a further costume in response to Smiffys’ claim that it is a direct copy of Smiffy’s original costume design.


Henbrandt Limited has also agreed to remove a number of its costume designs from its website and its catalogue in response to Smiffys’ claim that they are direct copies of Smiffys' original costume designs. They have also agreed to pay a substantial amount towards Smiffys' legal costs and expenses in the matter.


Henbrandt's MD Julian Starns, agreed in the form of signed contractual undertakings, not to sell any of the costumes, to remove them from their website and catalogue and to deliver-up any stock that came into its possession.


Wicked Costumes also immediately removed its costume design from their website and agreed to deliver-up any stock that came into its possession in response to Smiffys’ solicitors’ letter. 


Wicked Costumes’ MD, Steve McAllister provided Smiffy's with a signed contractual undertaking agreeing not to accept any further orders for the costume and wrote to any customers who have been offered the Victorian Dodger Costume, explaining that any orders they have made for stock of that costume cannot be fulfilled by Wicked Costumes Limited.
